Today, Judge Susan Richard Nelson issued an Order denying the National Hockey League’s motion to dismiss a putative class action brought by retired NHL players who suffered concussions or repeated sub-concussive injuries while playing in the NHL. The Court concluded that the players had adequately alleged claims for fraud, and rejected the NHL’s argument that the players’ claims were time-barred as a matter of law. This is a significant step forward for the players, several of whom are represented by Bassford Remele.
