Bassford Remele Shareholders Cecilie Loidolt and Kelly Putney obtained a defense verdict in a medical malpractice “birth injury” case venued in federal court. The verdict followed a four-week trial in which it was claimed that the fetal heart rate monitor showed abnormalities during labor that were indications for an earlier c-section and that an anoxic injury occurred in the last hour before birth, severe enough to cause severe global hypoxic ischemic encephalopathy and cerebral palsy. Plaintiff’s counsel requested a verdict in excess of $17 million, $15.8 million of which was for future life care costs. The jury found no negligence after one hour of deliberations. The case is one of the largest exposure medical malpractice cases ever tried in the State of Minnesota.
