Bassford Remele 2025 Health Care Seminar

Wednesday, June 18, 2025

Please join the Bassford Remele Health Care Practice Group for an essential discussion on recent legal developments impacting healthcare providers, legal professionals, and risk
management strategies. Attendees will receive practical guidance and actionable strategies to navigate recent legal changes, improve compliance, manage risk, and support both staff
and organizational health. Gain actionable insights, network with peers, and stay ahead of evolving legal and regulatory challenges.

SCHEDULE
12:00–12:30 pm: Lunch

12:30–1:15 pm: Talkin' Experts: The Implications of Rygwall
Presenters:
Kate Baker, Assistant Counsel, Risk Management, University of Minnesota Physicians
Stephen Plunkett, Shareholder and Long-Term Health Practice Group Chair, Bassford Remele

  • The Minnesota Supreme Court in Rygwall reaffirmed the causation standard in medical negligence lawsuits - a plaintiff must show by qualified expert testimony that it is “more likely than not that the defendant’s conduct was a substantial factor in bringing about the result”. More specifically, the Rygwall court requires that a qualified expert, whose opinion relies on proper foundation, must adequately explain the “how” and “why” the medical provider’s alleged negligence caused the plaintiff’s claimed injury, such that a court is satisfied that a jury will be able to decide liability without engaging in speculation or conjecture.

1:15–1:30 pm: Break

1:30–2:00 pm: Critical Updates: The Impact of Recent Regulatory and Legislative Changes on Healthcare Billing and Revenue Cycle Management
Presenter:
Jessica Klander, Shareholder and Chief Operating Officer, Bassford Remele

  • Minnesota’s regulatory landscape is rapidly reshaping how healthcare providers approach billing and collections. Recent legislation—including the Financial Screening Law and the Debt Fairness Act—introduced significant changes that directly impacted hospital and clinic operations. These laws now require providers to screen all patients for insurance and charity care eligibility, broadened the definition of “collecting party” to include providers themselves, eliminated spousal liability, and prohibits care denial or suspension based on unpaid medical debt. This session will provide a practical overview of these legal changes, their operational implications, compliance challenges, and what providers should anticipate going forward.

2:00–2:45 pm: Text Rx: Navigating Risks & Best Practices in Healthcare Communications
Presenters:
Andrew James, Counsel, Bassford Remele
Beth LaCanne, Attorney, Bassford Remele

  • In the healthcare setting, every word—spoken, written, or texted—carries immense weight. This session dives into the perilous intersection of miscommunication, inadequate documentation, and legal and regulatory risks. Beyond patient safety, we'll confront the emerging threats of unprofessional text-based communication among staff or directed at employees, including the potential for harassment and a toxic work environment. We will discuss actionable strategies, illuminated by real-world case studies, to proactively mitigate risk, enforce professional standards, and cultivate a culture of safety and mutual respect for both patients and your invaluable staff.

2:45–3:00 pm: Break

3:00-4:00 pm: Shielding the Carer, Understanding and Managing Secondary Trauma in Legal Professionals*
Presenters:
Sarah MacGillis, Outreach Director, Lawyers Concerned for Lawyers
Jennifer Bovitz, Shareholder and Associate General Counsel, Bassford Remele

  • Attorneys who work in or behalf of health organizations work with individuals who have experienced trauma including as a result of sentinel events. This session will explore how the work we do and the exposures we have may cause vicarious trauma. We will explore how lawyers working in healthcare can recognize the symptoms of trauma in ourselves and others and how effective mental health strategies and policy implementation can lead to healthier organizations.
