Bassford Remele Bankruptcy and Creditors' Remedies Chair Jeffrey Klobucar and shareholder Cameron Lallier will present "Emerging Issues and Recent Trends in Subchapter V" at The 2024 Bankruptcy Institute.

  • This presentation will explore the latest developments and emerging trends in Subchapter V of Chapter 11 bankruptcy. The panelists will review recent cases addressing eligibility, confirmation of cramdown plans, and other hot topics and trends within Subchapter V. They will also review and discuss strategies and considerations related to financing in Subchapter V.

Jeffrey Klobucar is a commercial litigator having experience in all aspects of complex litigation in both state and federal court matters, with a particular focus on bankruptcy matters involving representation of debtors, creditors, and Chapter 11 creditor committees.

Jeff regularly represents entities in other federal and state court litigation and appellate matters as well. He routinely handles cases involving the enforcement of contract rights, including security agreements and commercial leases involving both real estate and personal property. He also pursues commercial post-judgment collection matters, including enforcement of judgment liens and guaranties, commercial garnishment actions, evictions, and determinations of non-dischargeability in bankruptcy court. Jeff is dedicated to protecting the rights of his clients in bankruptcy and other federal and state court matters. Additionally, he has significant complex class-action and multi-district litigation experience.

Cameron Lallier's practice focuses on representing banks and other financial institutions in matters involving workouts, bankruptcy and the enforcement of security interests. His practice also includes representation of Chapter 11 debtors.

Cameron represents financial institutions in commercial loan transactions and the restructuring of troubled loans. He has represented a variety of asset-based lenders and equipment lenders in Chapter 11 bankruptcy cases. Cameron also represents many other financial institutions in both commercial and consumer regulatory and compliance issues such as the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act. Cameron also has experience working with purchasers of various companies and assets from Chapter 11 debtors. He has worked with bankruptcy trustees, creditor committees, and trade groups in a variety of cases both in Chapter 11 proceedings and out-of-court workouts.
